Terms of Use - Level Up Life

LICENSED APPLICATION END USER LICENSE AGREEMENT

The Products transacted through the Service are licensed, not sold, to You for use only under the terms of this license, unless a Product is accompanied by a separate license agreement, in which case the terms of that separate license agreement will govern, subject to Your prior acceptance of that separate license agreement. The licensor ("Application Provider") reserves all rights not expressly granted to You. The Product that is subject to this license is referred to in this license as the "Licensed Application."

a. Scope of License

This license granted to You for the Licensed Application by Application Provider is limited to a non-transferable license to use the Licensed Application on any Apple-branded Products that You own or control and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions, except that such Licensed Application may be accessed and used by other accounts associated with You via Family Sharing or volume purchasing.

b. Maintenance and Support

Application Provider is solely responsible for providing any maintenance and support services with respect to the Licensed Application, as specified in this license agreement, or as required under applicable law. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Licensed Application.

c. Warranty

Application Provider warrants that the Licensed Application will conform to any applicable specification or warranty for ninety (90) days from the date of download; provided, however, that in the event of a breach of warranty, Your sole remedy (and Application Provider's sole liability) will be refund of the price paid for the Licensed Application, and that, to the maximum extent permitted by applicable law, Application Provider disclaims all other warranties and conditions, express or implied, and You acknowledge that Apple is not responsible for addressing any claims relating to the Licensed Application or Your possession and/or use of that Licensed Application.

d. Product Claims

You acknowledge that Application Provider, not Apple, is responsible for addressing any claims of You or any third party relating to the Licensed Application or Your possession and/or use of that Licensed Application, including, but not limited to: (i) product liability claims; (ii) any claim that the Licensed Application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation, including in connection with Your Licensed Application's use of the HealthKit and HomeKit frameworks. This Agreement does not limit Application Provider's liability to You beyond what is permitted by applicable law.

e. Intellectual Property Rights

You acknowledge that, in the event of any third-party claim that the Licensed Application or Your possession and use of that Licensed Application infringes that third party's intellectual property rights, the Application Provider, not Apple, will be solely responsible for the investigation, defense, settlement and discharge of any such intellectual property infringement claim.

f. Legal Compliance

You represent and warrant that (i) You are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) You are not listed on any U.S. Government list of prohibited or restricted parties.

h. Third-Party Terms of Agreement

You must comply with applicable third-party terms of agreement when using the Licensed Application.

i. Third-Party Beneficiary

You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of this Agreement, and that, upon Your acceptance of the terms and conditions of this Agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce this Agreement against You as a third-party beneficiary thereof.

By downloading, installing, or using this application ("Level Up Life"), you agree to be bound by these Terms and Conditions.

2. DESCRIPTION OF SERVICE

Level Up Life is a habit tracking and personal development application that gamifies daily life improvement through RPG-style progression mechanics.

3. USER RESPONSIBILITIES

You are responsible for maintaining the confidentiality of your account and password and for restricting access to your device.

4. PRIVACY POLICY

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the Service.

5. PROHIBITED USES

You may not use our service for any illegal or unauthorized purpose nor may you violate any laws in your jurisdiction.

6. INTELLECTUAL PROPERTY

The service and its original content, features and functionality are and will remain the exclusive property of Level Up Life and its licensors.

7. TERMINATION

We may terminate or suspend your account and bar access to the service immediately, without prior notice or liability.

8. DISCLAIMER

The information on this service is provided on an "as is" basis. To the fullest extent permitted by law, we exclude all representations, warranties and conditions relating to our service.

9. LIMITATION OF LIABILITY

Level Up Life shall not be liable for any indirect, incidental, special, consequential or punitive damages.

10. GOVERNING LAW

These Terms shall be interpreted and governed by the laws of the jurisdiction in which Level Up Life operates.
